# Terms of Service

By downloading, installing, or using KobiStudio ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

## 2. Description of Service

KobiStudio is a mobile application that enables users to:
- Create and manage product catalogs
- Generate AI-powered photo and video advertisements using third-party AI services
- Schedule content generation
- Manage subscriptions for advanced features

## 3. User Accounts

### 3.1 Account Creation
- You must create an account using Apple Sign-In to access the App
- You are responsible for maintaining the confidentiality of your account credentials
- You must provide accurate and complete information during registration

### 3.2 Account Responsibilities
- You are solely responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
- You must be at least 13 years old to create an account

## 4. Subscription Plans

### 4.1 Available Plans
KobiStudio offers multiple subscription tiers:
- **Free Plan**: Limited monthly generations
- **Starter Plan**: Increased generation limits
- **Pro Plan**: Advanced features and higher limits
- **Business Plan**: Unlimited generations and premium support

### 4.2 Billing and Payment
- Subscriptions are billed through Apple's App Store
- Prices are displayed in your local currency and may vary by region
- Payment will be charged to your Apple ID account upon purchase confirmation
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period

### 4.3 Refunds
- Refund requests are handled by Apple according to their refund policy
- We do not have access to process refunds directly
- Contact Apple Support for refund inquiries

### 4.4 Cancellation
- You may cancel your subscription at any time through your Apple ID account settings
- Cancellation takes effect at the end of the current billing period
- You will retain access to paid features until the subscription expires

## 5. AI Generation Services

### 5.1 Third-Party Services
- The App uses third-party AI services (including fal.ai) to generate content
- AI-generated content quality and accuracy are provided "as-is"
- We do not guarantee specific results from AI generation requests

### 5.2 Usage Limits
- Generation limits are based on your subscription tier
- Limits reset monthly on your subscription renewal date
- Unused generations do not roll over to the next billing period

### 5.3 Content Guidelines
You agree not to use the App to generate content that:
- Violates any laws or regulations
- Infringes on intellectual property rights of others
- Contains hate speech, violence, or discriminatory content
- Depicts illegal activities or promotes harm
- Is sexually explicit or pornographic
- Impersonates any person or entity

## 6. Intellectual Property

### 6.1 Your Content
- You retain all rights to product information, descriptions, and photos you upload
- By using the App, you grant us a license to process your content for the purpose of providing the service
- You represent that you have all necessary rights to the content you upload

### 6.2 Generated Content
- AI-generated advertisements are provided for your commercial use
- You are responsible for ensuring generated content complies with applicable laws
- We make no warranties regarding the originality or intellectual property status of AI-generated content

### 6.3 App Ownership
- The App, including its design, features, and code, is owned by KobiStudio
- You may not copy, modify, distribute, or reverse-engineer the App

## 7. Privacy and Data

## 8. Prohibited Activities

You agree not to:

- Violate any applicable laws or regulations

## 9. Termination

You may stop using the App and delete your account at any time.

### 9.2 By Us
We reserve the right to suspend or terminate your account if you:
- Violate these Terms
- Use the App in a manner that causes harm to us or other users
- Engage in fraudulent activity

### 9.3 Effect of Termination
Upon termination:
- Your access to the App will be revoked
- Your data may be deleted according to our data retention policy
- Subscription fees are non-refundable upon termination for violation of Terms

## 10. Disclaimers

- We do not guarantee uninterrupted or error-free service
- We may modify or discontinue features at any time

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

### 10.3 AI Limitations
- AI-generated content may contain errors or inaccuracies
- You are responsible for reviewing and approving all generated content before use
- We are not liable for any consequences of using AI-generated content

## 11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability is limited to the amount you paid for the App in the past 12 months
- We are not liable for third-party services, including AI generation providers

## 12. Indemnification

You agree to indemnify and hold harmless KobiStudio, its affiliates, and its employees from any claims, damages, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Content you submit or generate using the App

## 13. Changes to Terms

- We may update these Terms at any time
- Material changes will be notified through the App or via email
- Continued use of the App after changes constitutes acceptance
- You are responsible for reviewing Terms periodically

## 14. Geographic Restrictions

- The App is available worldwide, subject to local laws
- You are responsible for compliance with local regulations
- Some features may not be available in certain regions

## 15. Governing Law
